Gunfire erupted Saturday night, Jan 14, 2023 at a Phoenix, AZ gas station leaving one teen dead.

As reported by AZcentral.com, “[o]fficers responded to the area of 43rd Avenue and Thomas Road for reports of a shooting around 9:30 p.m. on Saturday.”

According to the report, “[a]t around the same time, officers were called to a hospital regarding a teenager with a gunshot wound…[t]he two calls were then linked and worked as one investigation.”

Fox10Phoenix.com is reporting, “[p]reliminary information indicates that the victim, along with other juveniles, left the parking lot of a convenience store when an unknown suspect fired several rounds in their direction. One of those rounds struck the victim, who was transported to the hospital by the other juveniles.”

According to AZfamily.com, “[investigators] learned that [the suspect] had been working as a clerk when a group of boys entered the store and [allegedly] took off after taking several food items without paying. At that point, investigators say, [the suspect] chased after them and fired a gun. Detectives say at least one gunshot hit 15-year-old Bryan Perez, who later showed up at an area hospital before dying from his injuries. Over the course of the investigation, police learned that [the suspect] had changed his clothes to alter his appearance and hid evidence connected to the shooting. They also noted that [the suspect] never made contact with officers when they arrived after the shooting broke out.”
The shooting investigation is ongoing.

IS JUSTICE AVAILABLE? OUR LEGAL TAKE

FORMER CLIENT: I had lawyers calling me, and friends telling me who I should hire…I trusted in The Murray Law Firm and I’m glad I did.

Gas Station and convenience store patrons have a right to feel safe and secure while on the premises they are visiting. The level of security provided at the property is of significance, and is a relevant consideration when analyzing whether this shooting may have been prevented.  The following questions are also important in assessing whether this incident may have been avoided:

  • Have prior incidents of violence been reported on or near the property?
  • Was the owner or manager of the property aware that the suspect may have been armed while on duty?
  • Were any security personnel at the property?
  • What protocol was in place to deter crime and protect the victims at the time of the shooting?
  • Have authorities been to the property on prior occasions?

Property owners are generally required to protect against foreseeable harm to anyone and everyone legally on the premises.  Should the investigation into this incident reveal facts that establish that the property owner or management lacked adequate security to protect its visitors, or failed to properly hire or retain employees, the family of Bryan Perez may seek justice and elect to pursue legal claims and substantial compensation for their loss.
