Did a security failure contribute to the death of a Charlotte mother?

Echeverria de Gomez was reportedly shot during a violent robbery outside the Vista Villa apartment complex Tuesday morning, April 3, 2018.

According to WCNC, the shooting occurred “at the Vista Villa apartment complex in the 6200 block of Barrington Drive around 6:15 a.m.” WSOC TV reports, the “shooting and robbery happened in the parking lot” while Ms. de Gomez was “waiting for her brother to pick her up to head to work.” Tragically, she succumbed to fatal injuries.

Ms. de Gomez’s family has apparently suffered multiple robberies in the past. WSOC TV reports,  “the apartment complex is home to many Latinos who are afraid of police and immigration and often don’t report crimes.”

Our Legal Take

Apartment residents and guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided on the property and whether this tragedy may have been prevented.

  • Have there been prior crimes on the property and, if so, what additional security measures, such as gated-entry, bright lighting, surveillance cameras, and security patrols, were implemented by the apartment complex owner following any such criminal activity?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security to protect those on its premises, the family of Echeverria de Gomez may seek justice and elect to pursue legal claims for her wrongful death.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
