Did negligent security contribute to the shooting at a Birmingham apartment complex and are justice and compensation available to the victims?

LOCAL NEWS

Gunfire erupted at a Birmingham, Alabama apartment complex Tuesday night, May 21, 2019, leaving two people injured.  According to AL.com, “[t]he Jefferson County Sheriff’s Office and the Birmingham Police Department were investigating the shooting following a call of shots fired around 9 p.m. at the Valley Brook Apartments at 2921 Gallant Drive in Center Point.”  Two people were shot, one victim suffering life-threatening injuries, according to the report. No suspects have been identified.

There have been multiple reports of incidents of violence from this apartment complex.  AL.com reported on a shooting at this apartment complex in May 2016, CBS42.com reported on an incident in July 2016, and ABC3340.com reported on an incident in September 2013.

OUR LEGAL TAKE

Apartment residents and guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided at the apartment complex and whether this shooting may have been prevented.

  • What security measures, such as gated-entry, fencing, monitored surveillance cameras, and visible security patrols, were in place to deter crime and protect the victims at the time of the shooting?
  • What security changes were implemented as a result of prior incidents of violence on the property?
  • How was the suspect able to gain access on to the property?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner failed to provide adequate security to protect those on its premises, the victims may seek justice and elect to pursue legal claims for their injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victims retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
